Interactions with Mental Health Professionals
If the user chooses to interact with a mental health professional the user agrees that counseling/therapy may have both benefits and risks and that the success of therapy depends on a variety of factors. The company, as well as mental health professionals working under the authority of the company, cannot offer a guaranty of a cure for a particular problem.
In providng therapy, while the company agrees to make all reasonable efforts to protect confidentiality, the user is advised that limits of confidentiality exist and that certain information may not be protected under law. The user may request, if not already provided at the onset of service provision, written notification of confidentiality, consents, and contracts to treat. The user also agrees that insurance companies or HMOs are not likely to reimburse or authorize mental health treatment delivered without some disclosure of services provided.
Further, as the company is based in Florida, and all company mental health professionals are licensed or supervised by a mental health professional who is licensed by the Florida Department of Health, services shall be limited to persons physically located and seeking services in Florida.
Indemnifications
The user agrees to indemnify and hold harmless the company from any liability, cause of action, claims and expense, including reasonable attorney's fees and court costs, related to a violation of this Terms and Conditions Agreement and as a result of any information, material, or content placed on the website.
The user hereby releases and agrees to hold harmless and indemnify the company, its owners, directors, officers, employees, assigns, agents, and successors from any and all liability of causes of action and claims of any nature resulting from any information, good, or services accessed through this website.
This Terms and Conditions set forth herein shell be construed under and governed by the laws of the State of Florida, and any dispute arising from the Agreement of a breach of this Agreement shall be governed by the laws of the State of Florida.
Merger Clause
This Agreement constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes any and all other agreements, communication (written or oral) between the company and the user. The company may amend this Agreement or impose new conditions at any time, without notice. Any use of the website by the user shall constitute awareness, acknowledgment, and acceptance by user of all such amendments, modifications, or new conditions.
It is understood and agreed that if any part, term, provision or the Agreement is held by a court to be unenforceable, unlawful, or in conflict with any law of the State of Florida, the validity of the remaining terms of this Agreement shall not be altered, and the rights and obligations of the parties shall be construed and enforced as if the Agreement did not contain the part, term, or provision held invalid.
